Atcon Group of Companies [CCAA Monitor]

On March 1, 2010, the companies within the Atcon Group were subject to applications to the Court of Queen’s Bench of New Brunswick (Trial Division) in the Judicial District of Miramichi (the “Court”) to commence insolvency proceedings involving the Atcon Group. CCAA proceedings Pursuant to an Order of the Court made March 1, 2010 (the "Initial Order"), the Atcon companies listed below (the "CCAA Companies") were granted protection from their creditors pursuant to the Companies' Creditors Arrangement Act. The Initial Order appointed Ernst & Young Inc. as Monitor of the CCAA Companies. Atcon Construction Inc. Atcon Industrial Services Inc. Atcon Management Services Inc. Atcon Civil Ltd. Receivership and Bankruptcy proceedings Pursuant to an Order of the Court made March 1, 2010 (the "Receivership Order"), the Atcon companies listed below (the "Receivership Companies") were placed into receivership pursuant to Section 33 of the Judicature Act (New Brunswick) and Section 243(1) of the Bankruptcy and Insolvency Act. The Receivership Order appointed Ernst & Young Inc. as receiver and receiver manager of the Receivership Companies’ current and future assets, undertakings and properties. Atcon Group Inc. Atcon Holdings Inc. Atcon Veneer Products Inc. Atcon Logistics Inc. Atcon Property Holdings Inc. Pursuant to an Order of the Court made March 30, 2010 (the " Amended Receivership Order"), the Atcon companies listed below (the "Additional Receivership Companies") were also placed into receivership pursuant to Section 33 of the Judicature Act (New Brunswick) and Section 243(1) of the Bankruptcy and Insolvency Act. The Receivership Order appointed Ernst & Young Inc. as receiver and receiver manager of the Receivership Companies’ current and future assets, undertakings and properties. Atcon Construction Inc.
